Public Hearing Minutes

 

Public hearings were held before the New Plymouth Planning & Zoning Commission at the New Plymouth City Hall on Tuesday, May 27, 2008 at 7:04 p.m. Commissioners Tegethoff, Williamson, Byers, Presnell, Scheihing, Nay and Balcer were present. 

 

Guests included Jared Belanger, Richard Spath, Pat Thacker, Brett and Kayla Williams, Mohammad Popal, Brian Olsen, Milt Hooper, Joe Cook and Angela P'Pool. 

 

Crown Industrial - Variance Application:  Chairman Tegethoff explained the public hearing process and asked for public testimony. Jared Belanger (4625 Hwy. 72) testified that he was applying for a variance from the setbacks required in the Commercial zone. Mr. Belanger stated that he had been granted a conditional use permit for storage u nits but was unaware of the property setbacks required at that time. Mr. Belanger further testified that he began construction after being granted the conditional use permit and was aware of the setback violations during the building permit process. Mr. Belanger stated that he had not received the information that the Commission was reviewing. Commissioner Williamson made the motion to close the public hearing to allow Mr. Belanger to review the material that the Commission had. Commissioner Scheihing seconded the motion, which met with full approval.

 

 Abdul Rahmani - Conditional Use Permit Application: Commissioner Tegethoff asked for public testimony. Mohammad Popal testified that he was a partner with Abdul Rahmani and that they are requesting a conditional use permit to allow them to park two cars in their parking lot for the purpose of selling them.

 

Commissioner Scheihing asked where the cars would come from and Mr. Popal explained that he purchases them at auction. Commissioner Scheihing asked if there would be additional signage. Mr. Popal stated that there would be no signage except for a sale sign in the windows of the vehicles. Commissioner Balcer inquired as to the parking area between the diesel island and the school. Mr. Popal explained that the school has used the lot for parking and that he has discontinued public parking in the area. Commissioner Scheihing asked if Mr. Popal had experience and Mr. Popal responded that he has experience in the towing business, car lots and body shop.

 

Commissioner Byers informed the public that a letter of opposition had been received from the school district.

 

Brian Olsen (205 Mill Road) testified that he has a shop on Mill Road and that he does work for Mr. Popal. Mr. Olsen testified that he was in favor of the permit.

 

Commissioner Nay made the motion to close the public hearing at 7:35 p.m. Commissioner Williamson seconded the motion, which met with full approval.

 

Kayla Williams - Conditional Use Permit Application: Commissioner Tegethoff asked for public testimony. Kayla Williams (5617 Hwy. 52) testified that she was applying for a conditional use permit to allow a veterinary clinic in an Industrial zone. Mrs. Williams testified that she was interested in pursuing a veterinary clinic in New Plymouth and that there were not a lot of commercial properties available. Mrs. Williams further testified that the proposed location in the industrial park is accommodating in that it is in town and accessible, safe to load and unload animals, and that barking will not be disruptive to neighbors. Mrs. Williams introduced Pat Thacker, a realtor who has been assisting her with the process.

 

Commissioner Scheihing asked what Mrs. Williams specialty was and Mrs. Williams replied that a building would be built and that she is able to work on all animals. Mrs. Williams further explained that she is doing small animals at her current job and at the proposed clinic she would do small animals with plans in the future to do horses. Commissioner Balcer asked if there would be boarding of animals. Mrs. Williams stated that there was no intention to do it at this time, but would like to leave the option open for the future.

 

Commissioner Presnell inquired as to the size of the property and Mr. Thacker explained that it was a little over a half acre. Commissioner Tegethoff asked how much traffic they estimate during a day. Mrs. Williams stated that it was hard to estimate but figured twenty to thirty cars a day. Commissioner Byers asked about disposal of animal wastes and Mr. Thacker explained that biohazard materials have to be disposed of properly and are picked up, that small animal waste will be disposed of in the sewer. Mr. Thacker further explained that any horses would be in a pen and that the waste would be disposed of in a dumpster. Mrs. Williams stated that many places dispose of the small animal waste in a dumpster also.

 

Mr. Thacker testified that the proposed location has a wide street with two accesses and that the clinic would employ six to ten part time employees after it was established. Commissioner Balcer asked what the operation of hours would be. Mrs. Williams stated that it would be Monday through Friday until 5:30 p.m. and half day on Saturdays.

 

Commissioner Williamson made the motion to close the public hearing at 7:42 p.m. Commissioner Nay seconded the motion, which met with full approval.

 

Crown Industrial - Variance Application: Jared Belanger testified that he was unclear about an issue in the opinion submitted by the city attorney. Commissioner Byers explained that a city employee cannot authorize anything that is against code. Commissioner Tegethoff explained that the Commissioner does not enforce code and that informing citizens of the setback requirements is not in their job description.

 

There was discussion regarding fence placement, property and vacates.

 

Commissioner Byers made the motion to close the public hearing at 8:05 p.m. Commissioner Balcer seconded the motion, which met with full approval.
